For example, a manager or leader may state that the firing is simply a “job elimination.” They may remove the job title entirely, only to create a similar position with a different title soon after. Often when utilizing this tactic, employers specifically create the job with younger individuals in mind.

Another common instance of wrongful termination is encouraging older employees to leave by baiting them with retirement benefits. This can serve as a tempting offer to some, especially when money is on the table.

Refusal To Promote

Promotions should be offers equal and accessible to all individuals at a business or place of work. However, employers may choose to deny individuals a promotion for several different reasons. Unfortunately one of the most common reasons is due to an individual’s age.

In these instances, an older employee may apply for a promotion that they are highly qualified for. Only to find out later that a younger, less skilled, and unqualified employee ended up receiving the promotion.

This is a clear example of age discrimination and can serve as grounds for a claim against the employer.

Negative Comments Regarding Age

Other employees, managers, or leaders may also choose to engage in negative comments concerning an individual’s age. In doing so, they are contributing to a toxic workplace environment. Even comments made in passing or intended as jokes can cause an individual to feel uncomfortable in the workplace.
